Welcome to the Maxxis International ("Maxxis") Web site (the "Site"). Please review the following basic terms that govern purchase of products from our Site, including important warranty information. Please note that your use of the Site constitutes your agreement to follow and be bound by these terms. PURCHASING FROM THE MAXXIS eSTORE
Maxxis encourages you to purchase from a Maxxis authorized dealer or distributor ("Maxxis Authorized Dealer") if at all possible, to ensure professional advice and installation of our performance products. In order to make our performance products available in areas where there are no Maxxis Authorized Dealers, we are proud to offer a select number of Maxxis products on-line. Currently, we offer our complete Bicycle product line, Maxxis Factory Authorized Gear and selected Maxxis Trailer, Specialty Off-Road, and ATV tires for on-line purchase via the Maxxis eStore.
MAXXIS eSTORE RETURN POLICY
Maxxis' eStore return policy is divided into two sections as shown below:
Bicycle Tires and Factory Gear
Only those products purchased directly from Maxxis, of current production models and appearing on a current price list, are eligible for return. Unless an incorrect product is shipped, we are unable to refund any shipping charges. Returns of non-defective bicycle tire and factory gear products are only allowed up to 90 days after the date of purchase.
Merchandise ordered in error may be returned, freight prepaid by you, for a full refund of the purchase price or credit towards another purchase, less a 15% restocking fee. Close-out product sales are final and are not eligible for return. Tires may not be mounted, marked, or used in any way. All merchandise must be returned unused in original packaging. All returned merchandise will be inspected by Maxxis.
Bicycle and factory gear products with defective material or workmanship may be returned (freight prepaid by you) in accordance with Maxxis's Limited Warranty. For instructions on submitting a claim, please see "WARRANTY INFORMATION" below.
Returns of Maxxis products are not permitted unless a return authorization number is clearly marked on the outside of the package. Packages without a return authorization number will be refused. Return authorization numbers may be obtained by calling 678.407.6700 Monday-Friday 8:00 a.m.-5:00 p.m. (EST), except for holidays.
If the merchandise was not purchased directly from Maxxis, please consult the point of purchase for answers to any return questions.
Racing, Specialty Off-Road, Trailer and ATV Tires
Only those products purchased directly from Maxxis, of current production models and appearing on a current price list, are eligible for return. Unless an incorrect product is shipped, we are unable to refund any shipping charges. WARRANTY INFORMATION FOR PRODUCTS PURCHASED FROM THE ESTORE (APPLIES TO U.S. MARKET ONLY)
Limited Warranty:
- Bicycle Tires
Maxxis warrants to the original retail purchaser of every new MAXXIS® brand bicycle tire purchased from Maxxis via the eStore, and used exclusively in North America ("Bicycle Tire"), that the Bicycle Tire will be free from defect in material and workmanship until (i) six months from the date of purchase or (ii) such time as there is no serviceable original tread depth (as determined at the reasonable discretion of Maxxis) remaining on the Bicycle Tire, whichever is the first to occur. Only those Bicycle Tires of current production models and appearing on a current price list are eligible for return under this limited warranty.
- Racing and Specialty Off-Road Tires
Maxxis warrants to the original retail purchaser of every new MAXXIS® brand racing and specialty off-road tire (excluding Creepy Crawler) purchased from Maxxis via the eStore, and used exclusively in North America ("Specialty Tire"), that the Specialty Tire will be free from defect in material and workmanship until four years from the date of purchase. The foregoing warranty shall not apply if the Specialty Tire is used in a competition or for other competitive purposes. For clarity, Maxxis Creepy Crawler tires are sold "as is" without warranty of any kind.
- Trailer Tires
Maxxis warrants to the original retail purchaser of every new MAXXIS® brand trailer tire purchased from Maxxis via the eStore, and used exclusively in North America ("Trailer Tire"), that the Trailer Tire will be free from defect in material and workmanship until four years from the date of purchase.
- ATV Tires
Maxxis warrants to the original retail purchaser of every new MAXXIS® brand ATV tire purchased from Maxxis via the eStore, and used exclusively in North America ("ATV Tire"), that the ATV Tire will be free from defect in material and workmanship until one year from the date of purchase. The foregoing warranty shall not apply if the ATV Tire is used for racing, in a competition, or for other competitive purposes.
- Factory Gear
Factory Gear is sold "as is" without warranty of any kind.
* * As used in the following paragraphs under this heading "Warranty Information For Products Purchased From the eStore," the term "Merchandise" means any or all of the following to which a warranty applies: Bicycles Tires, Specialty Tires, Trailer Tires and/or ATV Tires. * *
Remedy:
Maxxis will replace the defective Merchandise with comparable new MAXXIS® Merchandise (shipped freight prepaid by Maxxis) OR will refund the full amount of the purchase price (not including any taxes or shipping charges paid by you when ordering the Merchandise or any shipping charges incurred by you in returning the defective Merchandise to Maxxis). Merchandise that is not found to be defective will be returned to you upon request, freight prepaid by you. However, if Maxxis does not receive a request for return with freight prepaid within 30 days of the final inspection report, Maxxis will dispose of the Merchandise.
Exclusions: The Limited Warranty with respect to Merchandise does not apply to damage or defect relating to: (1) road hazards (such as cuts, snags, punctures, or bruises), impact breaks, tire plugs, tire repair, vandalism, accidents, intentional damage, abusive or unusual operating conditions, fire, burns, or chemical corrosion; (2) Merchandise that is grooved; (3) improper operation or maintenance such as, but not limited to, under or over-inflation, or load, speed and inflation practices resulting in excessive operational conditions; (4) improper sizing, wheel alignment, tire mounting or rim fit; or (5) bicycle, trailer or vehicle mechanical problems such as, but not limited to, faulty, worn, or malfunctioning brakes.
Warranty Disclaimer: EXCEPT AS STATED IN THE PARAGRAPH ABOVE ENTITLED "LIMITED WARRANTY" AND UNLESS OTHERWISE PROVIDED BY LAW, THERE IS NO WARRANTY OF MERCHANTABILITY OR OF FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTY, EXPRESS OR IMPLIED, WITH RESPECT TO THE MERCHANDISE.
Limitation of Remedy: Replacement of the Merchandise or a refund as described in the paragraph above entitled "Remedy" is the sole and exclusive remedy in the event of breach of any warranty or of any agreement relating to the Merchandise.
Limitation of Liability: IN NO EVENT SHALL MAXXIS BE LIABLE FOR ANY INCIDENTAL, INDIRECT, SPECIAL OR CONSEQUENTIAL DAMAGES OR LIABILITIES (INCLUDING, BUT NOT LIMITED TO, INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR LOSS OF TIME, INCONVENIENCE, LOSS OF USE OF BICYCLE, TRAILER OR VEHICLE, OR ANY OTHER CONSEQUENTIAL OR INCIDENTAL LOSS) IN CONNECTION WITH THE PURCHASE, USE, OR OPERATION OF THE MERCHANDISE, WHETHER DUE TO A BREACH OF WARRANTY, BREACH OF CONTRACT, OR OTHERWISE.
Warranty Claim Procedure: You may make a claim under this Limited Warranty by contacting Maxxis at 1.866.509.7067 to obtain a return authorization number and shipping instructions. Return of Merchandise without a return authorization number clearly marked on the outside of the package will not be accepted.
RETURN OF PRODUCTS PURCHASED FROM MAXXIS AUTHORIZED DEALERSA claim under the
Maxxis Limited Warranty may be made by presenting to the Maxxis Authorized Dealer: the original proof of purchase for the tires; the tires that are the subject of the claim (and, in the case of Specialty Off-Road Tires, the tires must be mounted on the original vehicle); the service maintenance records (in the case of Specialty Off-Road Tires); and the completed Warranty Claim Form given to you by the Maxxis Authorized Dealer.
You are responsible for payment of charges for services you request that are not covered in the Limited Warranty.
PAYMENT METHODS
Maxxis accepts Visa, Discover, MasterCard, American Express, and debit cards for Maxxis eStore orders.
SHIPPING METHODS
The Maxxis eStore accepts orders 24 hours a day, 7 days a week, and 365 days a year. However, our business offices are only open Monday-Friday 8 a.m.- 5 p.m. (EST), excluding the following holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day (and the day after), Christmas Eve, Christmas Day. If any of these holidays falls on a Saturday, we will take the Friday before off. If a holiday falls on a Sunday, we will take the Monday after off.
If you place an order on a Saturday, it will not be processed until the following Maxxis business day. By choosing 2nd Day Air or Next Day Air, you understand that any orders placed after 10 a.m. (EST) will not be processed until the following business day.
All U.S. domestic orders will be shipped ground, unless otherwise specified. Ground orders can be expected to arrive in 3-5 business days after you receive your email confirmation of your order in process. Free promotional items given through the eStore may be shipped separately from your order.
ORDER STATUS & TRACKING Maxxis is committed to providing efficient, accurate order fulfillment. An email confirmation of your order will come shortly after you place it. Once your order has been received and is in process, another email will be sent with your package tracking information. If you have any questions regarding order status, you may

Credit Card Liability
Unauthorized credit card charges and other credit card disputes about "billing errors" are governed by the Fair Credit Billing Act. This federal law limits your responsibility for unauthorized charges to $50. However, you must notify your credit card provider in accordance with the reporting rules and procedures listed in your account agreement and in the manner required by the Fair Credit Billing Act.
